DMCA Copyright Policy

AlwaysYou respects the intellectual property rights of others and expects users of our platform to do the same. This policy explains how AlwaysYou handles copyright infringement claims under the Digital Millennium Copyright Act (DMCA) and analogous provisions of Indian copyright law (Copyright Act, 1957).
⚠️ Important Notice for Users Uploading Audio
Uploading songs, films, or recordings owned by third parties (including Bollywood music, film soundtracks, or any commercial recording) without a valid licence constitutes copyright infringement. AlwaysYou's royalty-free music library provides a safe, licensed alternative. Users who repeatedly upload infringing content will have their accounts suspended.
1. Our Royalty-Free Music Library
AlwaysYou maintains a curated library of music tracks that are either:
- Licensed under Creative Commons (CC0 / CC BY) for personal use
- Obtained under royalty-free licences permitting use on our platform
- Public domain works
Each track in our library displays its licence type. Where attribution is required (e.g., CC BY), the attribution information is available in the track metadata. By selecting a track from our library, you agree to comply with its stated licence terms.
2. User-Uploaded Audio — Your Responsibility
When you upload your own audio to a gift site or invitation, you confirm at the time of upload that you have the legal right to use that audio. AlwaysYou does not pre-screen user-uploaded content for copyright compliance. You bear full legal responsibility for any content you upload.
Specifically, you must have one of the following for any audio you upload:
- Ownership of the copyright in the recording and the underlying musical work
- A valid synchronisation and master use licence from the copyright holder(s)
- A licence from a performing rights organisation (e.g., IPRS, PPL India) covering the specific use
- Written permission from the rights holder for personal, non-commercial digital display
3. Reporting Copyright Infringement (Takedown Notice)
If you believe that content on our platform infringes your copyright, please send a written notice to our designated agent at:
Your notice must include all of the following:
- Your full legal name, address, telephone number, and email address
- A description of the copyrighted work(s) you believe has been infringed
- The specific URL(s) of the infringing material on our platform
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on the copyright owner's behalf
- Your physical or electronic signature
Incomplete notices may not be acted upon. Knowingly submitting a false notice may result in liability under the DMCA and Indian law.
4. Our Response to Takedown Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Review and verify the notice within 5 business days
- Remove or disable access to the allegedly infringing content promptly
- Notify the user who posted the content that it has been removed
- Inform the user of their right to submit a counter-notice
5. Counter-Notification
If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notice to support@alwaysyou.in including:
- Your full name, address, phone number, and email
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake
- A statement that you consent to the jurisdiction of the courts in Bengaluru, Karnataka, India
- Your physical or electronic signature
If we receive a valid counter-notice, we may restore the removed content within 10–14 business days unless the original claimant provides evidence of legal action.
6. Repeat Infringer Policy
AlwaysYou has a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. A user who receives three or more valid DMCA takedown notices may have their account permanently suspended.
7. Safe Harbour
AlwaysYou acts as an online service provider hosting user-generated content. We comply with the notice-and-takedown provisions of the DMCA and analogous provisions of Indian law to qualify for safe harbour protections. We do not endorse, review, or take responsibility for the content uploaded by our users.
